CIArb NAB, presents a webinar, Parties Rights and Responsibilities under ISDS, on Thursday, July 21, 2021 @ 2 p.m. ET/ 11:00 a.m. PST.

The webinar is the first in a three-part series on UNCITRAL Working Group III– Reform or Replace the Investor-State Dispute Settlement System? that will explore the rights and responsibilities of ISDS parties, including a State’s right to assert a counterclaim against an investor claimant, retention of rights by investors to pursue claims following termination of an ISDS agreement, the effects and implications of third-party funding, and the liability of State-controlled entities.

Moderated by Dr. Alan Anderson, the panelists for the first webinar, Prof. Srilal M. Perera, Prof. Anthony Daimsis, and Mr. Ahmed Abdel-Hakam, will provide insights regarding parties’ rights and responsibilities, as well as various proposals and reforms under consideration before UNCITRAL Working Group III.  The panelists and the moderator are:

 Prof. Anthony Daimsis teaches at the University of Ottawa and is the Director of the BiJural (common law/civil law) National Program. He is also Director of Education for the CIArb Canada branch. Prof. Daimsis is an associate Door Tenant at Littleton Chambers in London, and a member of its international arbitrator group. His experience includes serving as both counsel, arbitrator and as an expert witness on foreign investment disputes, telecommunications and underground resources.

Prof. Srilal M. Perera is an International Legal Consultant and Independent Arbitrator. He was formerly, Chief Counsel of MIGA of the World Bank Group and Adjunct Professor of Law of the Washington College of Law of the American University. He is an Attorney from Sri Lanka and holds an LL.B. from the University of Colombo, a master’s degree from the School of Advanced International Studies (SAIS) of the Johns Hopkins University and a Ph.D. from Georgetown University in Washington.

Mr. Ahmed Abdel-Hakam is a Counsel in the Investment Arbitration and Public International Law practice of Eversheds Sutherland (London). He is a Solicitor-Advocate (Civil and Criminal higher Rights of Audience) before the Higher Courts of England & Wales and a French Avocat. Based in London, he represents clients in high-profile cross-border disputes with a multilingual element and across civil and common law jurisdictions. He provides training to governments on investment treaty arbitration and is a contributor to Oxford University Press’ online publication “Investment Claims.”

Dr. Alan M. Anderson, PhD, FCIArb, is a Fellow and a Council member of the Australian Centre for International Commercial Arbitration, a Fellow of the Asian Institute of Alternative Dispute Resolution and an accredited international mediator. He has participated in the work of UNCITRAL’s Working Groups II and III since 2015. He is the President of Alan Anderson Law Firm LLC in Minneapolis, MN, and an associate Door Tenant with Littleton Chambers in London, and a member of its international arbitrator group. He is the co-editor of The Investor-State Dispute Settlement System: Reform, Replace or Status Quo? which was published in late 2020 by Kluwer Law International.
