15 Sep 1pm ET/10am PT ““Schein”-ing a Light on Circuit Splits — Non-Signatories, Delegation, and the Coming Battle Over Arbitration Discovery Under 28 U.S.C. § 1782”

Circuit court splits have caught the Supreme Court’s attention over the past year, resulting in some stunning outcomes. Among the issues federal courts have addressed are compelling discovery in international arbitration, enforcing arbitration agreements against non-signatories, and re-interpreting the standard for delegation. The Supreme Court has already weighed in on non-signatories, has granted cert once again on delegation, and is anticipated to take up the issue of compelling discovery.
